This website is owned and operated by Jill Fairbairn trading as Thrive.

These terms and conditions highlight the general use of the website and the services provided by Thrive online and in the studio.

All personal information held by Thrive is treated as private and confidential. It is used solely by Thrive and will not be disclosed to other parties.

The client understands that the Thrive may refuse to undertake treatment should this be contraindicated due to medical or other conditions that the client may present with, due to concerns regarding the health, safety and wellbeing of either the client or the massage therapist.

The client understands that the massage therapist/coach does not diagnosis illness, disease or any other physical or mental disorder. The massage therapist does not prescribe medical treatment nor perform spinal manipulations. Understand that you hold all responsibility for the treatment you receive.

Please note clients must be 18 or over, or 16 and accompanied by an appropriate adult.

Each person reacts differently to massage and in no case does Thrive Therapy guarantee any particular outcome from a treatment or series of treatments.

Thrive reserve the right to refuse or terminate treatment to any client, at her own discretion, refuse, discontinue or defer treatment. In this instance full payment is still required and no refund will be given. Examples of when this may occur include:

If the client is under the influence of alcohol or recreational drugs at the time of treatment;
If the client has withheld or not provided information relevant to treatment;
If the client’s actions, words or behaviour are inappropriate or of a sexual nature;
If the client is threatening, aggressive or violent, or in any way poses a risk to the therapist.

Please read these terms and conditions carefully.

Your use of the website and any purchases of products/services online or at the treatment studio will be subject to these terms and conditions. By using the website and any products or services, you now hereby agree to these terms and conditions.

Cancellation Policy

All treatments must be prepaid before your appointment/treatment and all clients must agree to the cancellation policy.

At least 48 hours is required to cancel or reschedule appointments. If you choose to reschedule, your payment will be transferred over to your future booking.

Appointments cancelled between 24-48 hours will incur a 50% charge

Appointments cancelled within 24 hours, and missed appointments are non-refundable.

Please be aware that arriving 15 minutes late will be classed as a missed appointment. I understand your time is valuable, so please extend the same respect to mine.

The above applies to all services, including those paid for by gift card.

Important Liability Statement

Any information or services available throughout or in connection with the website, or at any treatment given by Thrive, do not constitute medical advice and it is your responsibility to determine, through obtaining appropriate medical advice, that you are fit and well for such treatment.

It is also vital that you supply me with correct information about yourself and update me immediately should this information happen to change. I cannot be liable for any incorrect information supplied to us. I try to make sure that all information contained on this website is correct, however, subject to the paragraph below, I do not accept any liability for any error or omission. I exclude all liability for any action you take, loss or injury you may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this website or provided through any service supplied by us to you.

You, your legal representatives and your heirs' release, waive, discharge and covenant, not to sue Thrive or Jill Fairbairn for any injury or death caused by their negligence or other acts.

Statutory Rights, Refunds and Cancellation

Treatment fees may be increased by Thrive at any time. The Proprietor shall give clients no less than 14 days’ notice prior to any increases.

The rights of cancellation, refunds and any limitation expressed in these terms and conditions do not affect your statutory rights as a consumer. Refunds in relation to products or services may only be refunded to the credit or debit card originally used to make the purchase.

Definitions

Services:

Any information and services ordered or provided by Thrive, via the website or booked treatments. Any electronic information supplied to you by Thrive will constitute part of “service” not a product, and cancellation rights will apply accordingly.

Products:

Any products for sale on the website, or in the studio.

Website Usage and Intellectual Property Rights

You may use the website for personal and lawful use and in accordance with these terms, you may not copy or use any material from the website for any commercial purpose.

The intellectual property rights in all contents of the website and supplied as part of the products or services, and the Thrive, Thrive Running brands’ trademarks and logos (“materials”) are owned by Thrive. Except to the extent expressly set out in these terms and conditions, you are not allowed to make any copies of any part of any materials, or remove or change anything on the website or studio, include or create links to or from the website without our written authority, or remove or change any copyright, trademark or other intellectual property right notices contained in any materials or copies thereof.

Liability

You are referred to the important liability statement at the top of these terms and conditions. Subject to that statement you agree that your use of this website and the service is on an “as is” and “as available” basis. On that basis, except as expressly set out in these terms, Thrive does not enter into conditions, warranties or other terms in relation to the website or the products or the services (including any implied term relating to quality, fitness for a particular purpose) or any guaranteed or predicted result.

The website may include links to external websites and co-branded pages. Thrive has included links to these websites and co-branded pages to provide you with access to information and services that you may find useful or interesting. However, Thrive is not responsible for the content of this website and pages or for anything provided by them.

Subject to the important liability statement, Thrive is not liable for failure to comply with these terms and conditions due to any event beyond its reasonable control, including, without limitation, the input of incorrect information by you.

Suspension and Termination of Service

Thrive may suspend the operation of the website for repair or maintenance work or in order to update or upgrade the contents or functionality of the website from time to time. Access to or use of the website or any websites or pages linked to it will not necessarily be uninterrupted or error-free.

Thrive may terminate the service immediately in the event you breach any of these terms and conditions or do not pay any sums due to Thrive (including if the credit/debit card you use is not valid or does not work for another reason).

Contract Information

No contract will exist in relation to the services or products until Thrive has confirmed to you by email the particulars of your order, the value of your order and the products or services (as applicable) you have purchased.

General

Thrive may change these terms and conditions from time to time. By browsing the website, you are accepting that you are bound by the current terms and conditions. You should check these each time you revisit the website. These terms and conditions form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter.

These terms and conditions shall be governed and interpreted in accordance with consumer law.
